McDonald's franchise owner sued over rat

The owner of a McDonald's franchise in Southlake, Texas, denies in court documents that a woman found a dead rat in her salad.

A suit says the wife of former Cowboys wide receivers coach and passing-game coordinator Todd Haley, Christine, ordered a salad from the franchise and took the food home. After she and the couple's nanny Kathryn Kelley began eating out of the salad bowl, they found a stiff dead roof rat, the suit claims, the Fort-Worth Star Telegraph reported.

The suit says the two women gagged and vomited repeatedly upon finding the rodent.

Haley called franchise owner Ken Lobato and he drove to her home to see the rodent, the lawsuit says.

The lawsuit says Lobato demanded the rat and the women refused to give it up.

"Ken Lobato is not liable in the capacity for which he is sued," the new motion filed by Lobato's lawyer says.
