William J. Smith and his production company, Baldwin Entertainment, had put three of Hicks' songs on sale via the Apple iTunes Music Store Web site.

In Hicks' hometown of Birmingham, Ala., U.S. District Judge Virginia Hopkins had granted Hicks' request for a temporary injunction against the sales and was scheduled to rule on a permanent injunction Wednesday, the Birmingham (Ala.) News reported.

Hicks' attorney, Joe Leak, said the settlement reached between Hicks and Smith Tuesday will keep the producer from using, selling or distributing any early Hicks' tapes. Hicks has possession of his master recordings and no money was exchanged, the attorney added.

Leak also said Hicks was pleased the case was resolved amicably, all other claims he has filed against Smith will be dismissed and the star "wishes Mr. Smith well."
