While two men who claim to be the father of Anna Nicole Smith's daughter were in a Florida courtroom, a paternity suit proceeded in California without them.
During a closed-door hearing, Los Angeles Superior Court Judge Robert Schnider ordered that the DNA sample taken from Smith last week be handed over from the Broward County, Fla., medical examiner and be tested for paternity by another expert, E! News said.
Larry Birkhead, one of Smith's ex-boyfriends, claims he's the father of Smith's 5-month-old daughter, Dannielynn, and filed the paternity suit in Los Angeles. Stern is listed as the father on the child's birth certificate.
The two were in Florida Tuesday attending a hearing on who will receive Smith's body for burial.
The California hearing also concerned jurisdiction over the paternity proceedings. Birkhead asked the California court to retain jurisdiction, alleging Dannielynn was conceived in the state. Stern's lawyers countered that the paternity case should be heard in the Bahamas, where the baby was born and lives.
Schnider ordered a paternity test be carried out on the infant.
Stern was served with papers to submit to testing during a recess in the day's hearing.
