"We're all doing fine," DePietro, 36, told RadarOnline. "We're grieving. We're not releasing how he passed at this time."
Kay, a Brookline, NH attorney who was born in Norwood, MA, died unexpectedly at age 40 on Saturday, December 31. He competed on Survivor in Fall 2008 and finished in eighth place.
The circumstances of Kay's death are publicly unknown, as the Brookline Police Department told RadarOnline it is not investigating Kay's passing and the chief medical examiner offices in New Hampshire and Massachusetts confirmed they are not looking into Kay's cause of death.
Fellow former Survivor castaways also appear to be left in the dark when it comes to the details surrounding Kay's sudden passing.

Anthony Robinson from Survivor: Fiji told the website, "No I haven't heard anything. We're all in shock and still don't know what happened. His family didn't want to release it. I respect that."
"We're sad about it," Robinson continued. "He was a really, really nice guy. He was a really kind guy. It's sad to see somebody that young and kind pass."
Kay was dubbed a 32-year-old lawyer from Walpole, MA when he competed on Survivor: Gabon. He was eliminated from the game on Day 21 after a tribal shuffle because he struggled to bond with his new Kota tribemates, who also feared he had a hidden Immunity Idol.
Kay told Reality TV World in a 2008 interview he ended up on Survivor after a casting scout approached him at a bar. After practicing law in Boston for five years, he left his daytime job before going on the show, saying he needed a change from the long hours and stressful environment. Kay called it a "mid-life crisis" at the time.
In addition to his girlfriend, Kay is survived by his two children, Reese Elizabeth and Jackson "Jax" Russell-Reid, as well as his mother Jean-Ann and sister Andrea.
