Sammi "Sweetheart" Giancola is presumably glad she got out of South Beach when she did.

While the alleged victim did file a police report after the incident and the complaint was forwarded to prosecutors, Chavez said the case will not move forward because Giancola has already left Miami.
"What happens here in Miami-Dade County is, when we investigated the case and spoke to all the witnesses, we did feel there was probable cause to charge to her with misdemeanor battery. However, she's out of jurisdiction," Chavez told E! News.
"If they're out, we're not going to expend the money to go and find them. But if she ever comes back, we'll definitely revisit the matter."
In addition, Chavez said Giancola isn't getting special treatment for being a reality star.
"It's not that we haven't treated it with a lot of consideration, but we would do this with anybody, even movie stars," she told E! News.
Giancola attorney James Leonard Jr. was unavailable for comment when contacted by E! News, which added it is still unknown if the alleged victim will file a civil suit.
Jersey Shore's second season will premiere Thursday, July 29 at 10PM ET/PT and begin with the cast living in Miami before they return to Seaside Heights, NJ for its conclusion. The cast reportedly left South Beach on May 22.
