The couple was granted permanent custody of Tyler on November 21. Jim Bob and Michelle were reportedly initially granted temporary guardianship of the child after they filed an emergency petition on August 26.
According to court documents obtained from the filing by ET, attorney Travis Story argued on behalf of the Duggars that Tyler's mother Rachel Hutchins -- who is Michelle's niece -- is unfit to be a parent.
Story alleged Rachel "recently exhibited a pattern of behavior demonstrating that she is presently unable to meet Tyler's health, safety, and other needs" and that she is "unemployed, has no means of transportation and is currently on probation."
Rachel, 23, was arrested on felony charges for breaking and entering in April, the Independent Journal Review reported.
Jim Bob and Michelle, who previously starred on 19 Kids & Counting, are already parents to the stars of Counting On, including Jessa Duggar and Jill Duggar. The spinoff currently airs on Tuesday nights at 8PM ET/PT on TLC.
