A spokesperson for the Maricopa County Superior Court in Phoenix said the judge rejected DMX's request because he was making progress in a substance abuse program mandated by the court. The program ends in early July.
The rapper was released from Maricopa County jail in May 2009 after serving 90 days of his 18-month sentence for cruelty to animals, theft and drug charges. The recording artist has previous convictions for assault, attempted aggravated assault, possession of assault firearm, criminal possession of a weapon, attempted robbery and attempt to purchase cocaine.
