Anna Nicole Smith's 5-month-old daughter, Dannielynn, should get Smith's body, a Broward County, Fla., judge ruled Thursday.

Richard Milstein, a court-appointed guardian, will act on the baby's behalf, the Miami Herald said.

In making his ruling, Broward Circuit Judge Larry Seidlin directed Milstein to work with all three adult parties who wanted Smith's body: Smith's estranged mother, Virgie Arthur; longtime attorney and companion, Howard K. Stern; and ex-boyfriend Larry Birkhead.

"I was concerned about Danny," said Seidlin, referring to Smith's son who died in September and is buried in the Bahamas. "He's in the ground in the Bahamas. Anna Nicole wants to be in that ground."

Seidlin also announced that Broward Judge Lawrence Korda would hear the paternity case.

As soon as the Seidlin session broke, Birkhead's attorney, Nancy Haas, left to file an emergency motion for paternity.

Both Birkhead and Stern claim to be the father of Smith's daughter. Stern is listed as the father on the child's birth certificate.

Smith died of unknown causes Feb. 8 in a Hollywood, Fla., hospital where she was taken after being found unresponsive in her hotel room.
