"I had to go to the police station where I had an appointment at 9PM to begin the process of being arrested," Swanson told People.
While O'Brien may have been the one to file the first complaint, Swanson -- who filed a counter complaint of her own on Sunday -- alleges she was not the one to initiate the altercation. Swanson's publicist Michael Sands said in a Monday statement released to E! News that Swanson and Eisler traveled to Canada to discuss the custody arrangements of O'Brien and Eisler's two children at O'Brien's home.
"The child of Kristy Swanson and Lloyd Eisler was in the back child safety seat of the minivan along with Lloyd's two young children," Sands said in the statement. "Kristy was accompanying Lloyd on a scheduled parental visit to Kingston."
However that's when things took a turn for the worse, as Swanson claimed she was attacked by O'Brien in-front of Eisler and O'Brien's children, People reported. According to Sands, investigators took photos of both alleged victims' injuries, with Swanson sustaining bruises and scratches to her back, left knee, arm and upper parts of her body.
"It's a she-said-she-said type of thing," Kingston Police Department Constable Mike Menor told E!. "Pretty cut and dry really." Kingston police will decide whether to arrest or charge O'Brien by Tuesday morning, according to People.
Sands seems pretty sure the alleged altercation between Swanson and O'Brien was O'Brien's fault, telling Toronto's Globe and Mail on Monday that he had to "go operational" upon learning O'Brien was trying to claim she was the victim. The headline of the statement he issued to the media was "Kristy Swanson assaulted by ex wife of Lloyd Eisler," according to the Globe and Mail. As for O'Brien's alleged injuries - -which reportedly include a black eye -- Sands told the Globe and Mail "her face likely collided with the car door when she lunged at" Eisler.
"Unless she punched herself in the eye when she got home," added Sands, the Globe and Mail reported.
"For them to do something like this in front of my kids is horrendous," O'Brien, who declined to talk about the specifics of the incident, told the Globe and Mail on Sunday night.
Swanson and Eisler -- a two-time Olympic pairs figure skating medalist and world champion -- were paired together by Fox for Skating with Celebrities in the summer of 2005. The pre-taped reality competition series premiered in January 2006, and one month later a then-pregnant O'Brien blamed an affair between Eisler and Swanson for breaking up their marriage. Eisler -- who has denied that his relationship with Swanson began before he and his former wife separated -- divorced O'Brien in November and currently lives in Los Angeles with Swanson. Swanson gave birth to their first child together, Magnus Hart Stewart, in mid-February.
"I am sorry that my ex-wife is being so vindictive," Eisler told E!. "I left my wife, contrary to what other media sources have reported in the past. My ex-wife is trying to cover up the assault by falsely pressing charges with the local constable first."
